Key Issue 2 – Access to review and limits on review powers
Applicants in migration and protection matters have different entitlements and timeframes to apply for review and limitations on adverse information being provided at review.
The Council wants to know about your experience of migration and protection decisions at the ART and the limits on the ART to review matters since its establishment in 2024. In particular, the Council wants to understand:
- any changes to the application and review processes of migration and protection matters and decisions because of the ART’s limitations on providing information
- whether there are further amendments that would support the ART’s goal of being accessible and responsive to the diverse needs of parties to proceedings.
