Part B – Alternative enforcement

Part B invites stakeholders to consider mechanisms that could support accountability, remediation and redress in connection with a proposed failure to prevent modern slavery offence. This includes both a deferred prosecution agreement (DPA) scheme and possible civil remedies.

These mechanisms seek to provide practical pathways to address non-compliance, promote corporate cooperation and remediation, support redress for victims where appropriate and encourage businesses to strengthen systems and controls to prevent modern slavery.

Stakeholder views are sought on the potential benefits, risks and implementation considerations associated with these approaches.

Question 4 – DPA scheme

Stakeholders may wish to comment on:

  • legal and regulatory factors relevant to the introduction and operation of a DPA scheme
  • international evidence and experience
  • appetite for engaging with such a scheme.
